 This document refers to the protection of individuals regarding the processing of personal data by Ovargado, S.A. (hereinafter referred to as OVG). The protection of your Privacy is one of our main goals.

OVG is permanently committed to the online protection of users of its IT platforms. This document therefore aims to make known our Privacy Policy and, specifically, the terms and conditions under which your personal data is processed by OVG, so that you can give your consent in a free and informed way to the treatment in question (how the data is collected, for what purpose it is used, how we treat it, with whom we share it, how long we keep it and how you can ask for its deletion).

Please note that if any of the current pages of the OVG website collect personal data, specific information is published here in accordance with the provisions of article 13 of (EU) REGULATION 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27th April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC – General Regulation on Data Protection (hereinafter, “Regulation”) , for your analysis before providing the personal data requested and collected by us, as mentioned above.


RESPONSIBLE FOR PROCESSING AND IN CHARGE OF PERSONAL DATA PROTECTION

The person responsible for the processing of personal data is the individual who manages OVG, who also assumes the role of Personal Data Protection Officer (DPO) and who is available to provide you with any information regarding the processing of your personal data by OVG, including the possible list of data protection processors. It is possible to contact the DPO by sending an email to rgpd@ovargado.pt with the subject “DPO”.


PROCESSED PERSONAL DATA

The personal data collected by us, depending on your decisions regarding the services to be subscribed to and the respective mode of use, may be part of the following categories: identifier such as a name; identification number; location data, an “online ID” or one or more characteristic elements of your physical, physiological, psychological, economic, cultural or social identity, suitable for your identification, in accordance with the type of services contracted by you (hereinafter referred to only as “Personal data”).

The personal data processed or collected through our website are the following:

– Navigation Data;

– Data provided voluntarily by the holder of the personal data (for example when subscribing to the newsletter or sending a contact email);

– Traffic data;

– Cookies.


COOKIES – WHAT ARE THEY AND WHAT ARE THEY FOR

Cookies are small text files that the online platforms visited by the user send and record on their computer or mobile device, to then be retransmitted to the same online platforms on future visits. Thanks to cookies, websites remember user actions and preferences (for example, login data, chosen language, font size and other display settings, etc.) so that they are displayed again when the user revisits that website online or navigates from page to page. Cookies are thus used to perform computer authentication, monitor sessions and store information about the activities of users who access there and which may also contain a unique identification code that allows monitoring of user navigation within the online website itself to statistical or advertising purposes.
Some operations cannot be carried out without the use of cookies, which, in some cases, are technically necessary for the correct functioning of the online portal/website. The user can configure his browser to refuse cookies, however, in this case, the website or parts of it may not function correctly.

– Name: _fbp // Category: Marketing // Purpose: Collects data on the journey of visitors between websites.


PURPOSE OF PROCESSING PERSONAL DATA

The processing of personal data that we intend to carry out, with your consent at the time of subscription, has the following purposes:

a) Allow the provision of the Services requested by you with a view to carrying out communications related to OVG‘s commercial relationship with the user;
b) Allow navigation and consultation of the OVG website;
c) Respond to requests for clarification or information, which OVG may receive via e-mail, via telephone or through the possible forms available on the website;
d) Comply with legal, accounting and tax obligations;
e) Send direct marketing communications (by sending electronic communications) regarding services similar to those subscribed to by the user, except in case of express opposition or regarding subsequent communications;
f) Preparing studies, surveys, market statistics with a view to improving the quality of the service provided;
g) For the sole purpose of security and prevention of fraudulent behavior.


GROUNDS FOR THE TREATMENT AND ITS MANDATORY OR OPTIONAL NATURE

The legal basis for processing personal data for the purposes indicated in points a), b) and c) of the previous clause is that contained in paragraph b) of paragraph 1 of article 6 of the Regulation, since the treatment in question is necessary for the provision of the Services subscribed by the user. Please note that the provision of personal data for these purposes is automatic, but you can request the annulment/deletion of this data at any time via email. The purpose indicated in point d) above, reflects a legitimate processing of personal data under the terms of paragraph c) of paragraph 1 of article 6 of the Regulation, since such processing is necessary for Ovargado.S.A. can fulfill with the legal obligations to which it is subject. The processing of personal data carried out for marketing purposes is based on the express and unequivocal consent of the user, in accordance with the provisions of paragraph a) of paragraph 1 of article 6 and paragraph c) of paragraph 2 of article 22 of the Regulation. Providing your personal data for this purpose is therefore optional. If you wish to object to the processing of your personal data for direct marketing purposes, you may do so at any time through our email contact rgpd@ovargado.pt.
The purpose referred to in point g) above is based on OVG‘s legitimate interest in detecting fraud committed against it, in accordance with the provisions of article 6(1)(f) of the Regulation.


RECIPIENTS OF PERSONAL DATA

Your personal data may be communicated, for the purposes described above, to the following entities:

a) subjects who normally act as subcontractors, that is: natural or legal persons who provide assistance and advice to OVG in technical, accounting, administrative, legal, fiscal, financial matters; entities with which it is necessary to interact in order to provide the Services or persons who carry out technical maintenance functions (including maintenance of equipment and electronic communications, etc.).

b) Entities to which OVG must communicate personal data in accordance with the provisions of the applicable legislation and/or in response to duly substantiated requests from the competent authorities.

c) Persons authorized by OVG to process the personal data strictly necessary to carry out operations related to the provision of the Services, which are contractually and/or legally bound by obligations of confidentiality and professional secrecy.

d) Business partners for specific purposes only in case the user has given his express, unequivocal and specific consent for this purpose. You can request, in writing, a list of data controllers with whom OVG relates in relation to your personal data to rgpd@ovargado.pt.


TRANSFERS OF PERSONAL DATA

None of your personal data is communicated to third parties for commercial or marketing purposes.


CONSERVATION OF PERSONAL DATA

Personal data processed for the purposes indicated above will be kept for the period of time strictly necessary to carry out those same purposes. Thus, the following are the retention periods for the following personal data of the user:
– Personal data processed for possible marketing purposes: these data may be kept until the data subject revokes the consent given. However, OVG has established that they must deleted three years after subscribing to the services.
– Data retained and processed with a view to profiling: in general, this type of personal data is retained until the data subject revokes consent, unless further clarification is provided in this regard by the competent supervisory authority.
– Relevant personal data for compliance with tax obligations: Such data will be deleted after 10 years of conservation, under the terms of the Tax Law.


PERSONAL DATA HOLDER RIGHTS

The user has the right to request OVG, at any time, to access their personal data, update them or remove them, in accordance with the provisions of the Regulation. You also have the right to request the limitation of the processing of your personal data, in accordance with the provisions of article 18 of the Regulation, to obtain your personal data in a structured format, in common use and readable by an automatic device, in the cases provided for in article 20 of the Regulation. The requests in question must be sent in writing to the email address rgpd@ovargado.pt.


TERM

This privacy policy is effective as of 12/09/2022. OVG reserves the right to modify or simply update, in part or in full, the respective content, with a view to complying with the applicable legislation in force at any given time. OVG will inform you of these changes as soon as they are introduced and they will be binding as soon as they are published on the OVG website, so you should check it periodically in order to be aware of the most up-to-date version of this Privacy Policy at all times and , in particular, on the processing of your personal data carried out by OVG.
